2. Services
We provide technology setup, configuration, and guidance using third-party platforms and tools. Unless explicitly stated in writing, DreamscapeMFS does not provide full-service marketing management, advertising management, or guaranteed lead volume.
Specific deliverables, timelines, and pricing will be outlined in separate written agreements or proposals.
3. Client Responsibilities
You agree to:
- Provide accurate and complete information required to perform services
- Maintain ownership of and responsibility for your business communications
- Ensure compliance with applicable laws, including SMS, email, and consumer protection regulations
- Obtain proper consent from your customers before sending marketing or automated messages
You are responsible for all content sent through systems configured on your behalf.
4. No Guarantees
While our services are designed to improve responsiveness, follow-up, and customer engagement, we do not guarantee specific results, including increased revenue, lead volume, or job bookings.
Business outcomes depend on many factors beyond our control, including your pricing, service quality, responsiveness, market conditions, and customer demand.
5. Third-Party Platforms
Our services rely on third-party software and platforms. We are not responsible for outages, changes, or failures caused by third-party providers.
You may be subject to additional terms and conditions imposed by those providers.
6. Payments and Fees
Fees, billing terms, and payment schedules will be specified in your service agreement or invoice. Failure to pay may result in suspension or termination of services.
All fees are non-refundable unless otherwise stated in writing.
7. Intellectual Property
All materials, processes, workflows, templates, and documentation provided by DreamscapeMFS remain our intellectual property unless otherwise agreed in writing.
You may use these materials solely for your internal business purposes.
8. Confidentiality
We will treat non-public business information shared with us as confidential and use it only to provide services. This obligation does not apply to information that is publicly available or obtained lawfully from other sources.
9. Limitation of Liability
To the fullest extent permitted by law, DreamscapeMFS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
Our total liability for any claim shall not exceed the amount you paid to us in the three (3) months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless DreamscapeMFS from any claims, damages, or expenses arising out of:
- Your use of our services
- Your violation of these Terms
- Your failure to comply with applicable laws or regulations
11. Termination
Either party may terminate services in accordance with the terms outlined in a separate service agreement. Upon termination, access to systems or automations we manage may be suspended or removed.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the state in which DreamscapeMFS operates, without regard to conflict of law principles.
13. Changes to These Terms
We may update these Terms from time to time. Any changes will be posted on this page with an updated “Last updated” date.
